The petitioners are apprehending their arrest in a case instituted under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.
Allegation against the petitioners is to have killed father of the informant.
It has been submitted on behalf of the petitioners that they have got no criminal antecedent. They have been made accused in the present case on the basis of suspicion due to previous enmity. Except the same, there is no other material in the case diary to suggest his implication in the present case. On behalf of the State, it is submitted that except suspicion, no other material has come in course of investigation against the petitioners.
On behalf of the informant it has been submitted that
Patna High Court Cr.Misc. No.25918 of 2015 (3) dt.22-09-2015 2 / 2 there is strong suspicion against the petitioners for committing the alleged offence.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Sabour P.S. Case no. 66 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
