Counsel for the informant is also present.

The petitioner is in custody since 22.06.2017 in connection with Pirbahore P.S.Case no. 321 of 2017 registered under Sections 147, 149 and 302 of the Indian Penal Code. Learned Senior Counsel appearing on behalf of the petitioner has submitted that the petitioner has been dragged in this case only on suspicion. Admittedly, the informant is not an eye witness to the alleged occurrence and as per allegation made in the FIR, the deceased was dragged and beaten upon and thereafter he was done to death. Patna High Court Cr.Misc. No.48660 of 2017 (2) dt.18-10-2017 2/2 indicate any external or internal injury. However, in order to ascertain the cause of death, the viscera report has been sent for examination to the Forensic Science Laboratory. Learned counsel for the petitioner has further submitted that the petitioner has taken a room for studying at Patna and that the petitioner has no criminal antecedent.

In view of the aforementioned facts and circumstances of the case let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Patna in connection with Parbahore P.S.Case No. 321 of 2017.
