JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 341,323,376 and 506/34 of the Indian Penal Code.
Though initially the FIR was registered under sections 341,323,376 and 506/34 of the Indian Penal Code with accusation that the petitioner ravished the informant but on completion of investigation charge sheet was submitted under sections 341,323,354 and 504 of the Indian Penal Code and accordingly the order of cognizance was passed.
It is submitted by the learned counsel for the petitioner that initially the accusation was not found true either by the police or by the learned court below. The petitioner is neighbour of the
Patna High Court Cr.Misc. No.26009 of 2015 (2) dt.01-07-2015 2/2 informant and has been falsely implicated in this case. It is further submitted that the initial accusation is not corroborated with medical report The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Babubarhi P.S. Case No. 53 of 2014 pending in the court of learned JM Ist Class, Madhubani.
This application is disposed of with the aforesaid observation/direction.
