The petitioner seeks bail in a case instituted for the offences under Sections 302, 201/34 of the Indian Penal Code. Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application. A report was called for from the Court below. It has been reported that four prosecution witnesses have already been examined in this case including the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.11.2015. He has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Petitioner has falsely been implicated in the present case. The informant is not an eye

It has further been submitted on behalf of the petitioner that all the prosecution witnesses including the informant, who have been examined, they have been declared hostile by the Trial Court.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-IX, Patna in connection with Ram Krishna Nagar P.S.
