JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Pasraha P.S. Case No.59 of 2018 for the offence under Sections 341, 307, 504 of the Indian Penal Code, Sections 25(1-b) a /26/27/35 of the Arms Act and Section 37(b) of the Bihar Excise and Prohibition Amendment Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. The petitioner is in custody since 10.05.2018. He further submits that in the instant case, the allegation of firing against Rajiv Sharma and not against this petitioner.

Considering the fact that the petitioner was arrested on the allegation of consumption of liquor and he has remained in

Patna High Court Cr.Misc. No.40077 of 2018 (2) dt.10-07-2018 2/2 custody for two months, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III-cumSpecial Judge, Excise, Khagaria in connection with Pasraha P.S. Case No.59 of 2018.
