JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-07-2015 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 409 of the Indian Penal Code.

It is alleged that the petitioner being the ExChairman of Sikaria P.A.C.S. embezzled amount of Rs. 15,46,359/-.

It is submitted by the learned counsel for the petitioner that the petitioner has already deposited the alleged amount.

Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for two month in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today,

Patna High Court Cr.Misc. No.26773 of 2015 (2) dt.20-07-2015 on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad P.S. Case No. 10 of 2015, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The provisional bail of the petitioner will be confirmed by the learned court below after verification of the fact that the petitioner has already deposited Rs. 15,46,359/- and if the petitioner is found to has not deposited the said amount then the petitioner shall surrender before the learned court below and pray for regular bail.
