The petitioner seeks bail in connection with Aurangabad (Town) P.S. Case No. 94/2018 dated 25.03.2018 instituted for the offences under Sections 147, 148, 149, 504, 436, 427, 307, 160, 353 and 295(A) of the Indian Penal Code. During the Ram Navmi procession, a clash took place between the members of two religious communities and the members of the mob resorted to loot, arson and attack. 32 persons are named in the present/subject F.I.R. along with many unknown persons.
The learned counsel for the petitioner has submitted that in reference to the aforesaid communal clash, several F.I.Rs. have
Patna High Court Cr.Misc. No.40119 of 2018 (2) dt.10-07-2018 2/2 been lodged and the accused persons of one case have been remanded in other cases as well. This way, the petitioner has been made accused in 6 cases but all the cases relate to one incident only. There is no specific accusation against the petitioner in the F.I.R. and he is in custody since 01.06.2018. Some of the other accused persons, having similar allegation against them, have been granted bail by different Benches of this Court.
Considering the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) P.S. Case No. 94/2018.
