====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-07-2026 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 326, 61(2), 3(5) of the Bharatiya Nyaya Sanhita.
3. It is alleged that all the F.I.R. named accused persons, including these petitioners and some unknown persons set the house of informant on fire, while informant and her family members were sleeping inside, causing loss of foodgrains and other household articles.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.18405 of 2026(4) dt.23-07-2026 2/3 petitioners are innocent and have committed no offence. Petitioners have falsely been implicated in this case due to previous enmity. F.I.R. has been lodged after inordinate delay of about 30 days which itself raises doubt over veracity of the prosecution case. As a matter of fact, informant and her family members had set the house of petitioners on fire for which Nautan P. S. Case No. 168 of 2024 was lodged by the wife of petitioner no. 2 against informant and her family members in which, cognizance was taken on 10.03.2025 and after four months, this false and concocted case was lodged as an afterthought.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation, delay in lodging the F.I.R. and materials available on record, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Nautan P. S. Case
