2. The petitioners apprehend their arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 50 litres of country made liquor has been recovered from a motorcycle.
4. Learned counsel for the petitioner submits that petitioners have clean antecedent and they have falsely been implicated in the present case. He further submits that nothing has been recovered from conscious possession of the petitioners and their names transpired on the basis of disclosure made
Patna High Court CR. MISC. No.16474 of 2025(2) dt.08-04-2025 2/2 by apprehended co-accused person. He lastly submits that petitioners have no concern at all with the alleged recovery.
5. Learned APP for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances and the facts that petitioners have clean antecedent and nothing has been recovered from their conscious possession, let the petitioners, above-named, in the event of their arrest / surrender before the learned trial Court within a period of eight weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court-I, Banka in connection with Amarpur P.S. Case No. 826 of 2024, subject to the condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the BNSS, 2023.
