ANJANA MISHRA ORAL ORDER 05-08-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 31.12.2017 in connection with Adapur P.S. Case No.112 of 2017 registered for the offence under Sections 363, 366 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is allegation against one Aarif @ Wakar with whom the victim girl has eloped. It is further submitted that the petitioner is in custody since 31.12.2017 and as such, he may be extended the privilege of bail.

The statement of the victim girl is on the record, which clearly indicates the presence of the petitioner at all stages and the allegation against him are specific as having

Patna High Court CR. MISC. No.20614 of 2019(4) dt.05-08-2019 2/2 committed sexual offence against the victim girl and also having subjected to Marpit as well as forcing her to dance in the orchestra.

In view of the aforementioned facts and circumstances, I am not inclined to grant regular bail to the petitioner. It is, accordingly, rejected.
