2. The petitioner seeks bail in connection with Chhakarbandha P.S. Case No. 05 of 2021 instituted for the offence punishable under Sections 302/34, 120(B) of the Indian Penal Code and 27 of Arms Act.

3. The prosecution story in short is that informant and his father were going towards Bhaluahi ahar. In the meantime, accused persons holding country made pistol started assaulting his father and killed him. They also open fired on the informant which was missed.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he is falsely implicated in this case. It is further submitted that allegation against the petitioner is that,

It is further submitted that nothing has been recovered from the conscious possession of the petitioner and the allegation against the petitioner is general and omnibus in nature. It is further stated that other co-accused namely Ram Pravesh Paswan, Basant Paswan @ Basant Kumar and Brihaspat Paswan have been granted bail vide Criminal Miscellaneous No. 24980 of 2022 and Criminal Miscellaneous Case No. 56829 of 2021. Lastly, it has been submitted that the petitioner is in custody since 25.11.2022 and has no criminal antecedents, charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Sheghati (Gaya) in Chhakarbandha P.S. Case No. 05 of 2021.
