This application for anticipatory bail arises out of Jaipur P.S. Case No. 19 of 2018 for the offence punishable under Section 379/34 of the Indian Penal Code. There is allegation of commission of theft in the P.D.S. shop of the informant, for which First Information Report was registered against unknown. In course of investigation, the petitioner's name has transpired, who has a granary in Jharkhand from where the stolen articles were recovered. It is submitted on behalf of the petitioner that he has no criminal antecedent and there is no material basis to allege that the rice and wheat recovered from the petitioner's shop are the stolen articles.

Considering the facts and circumstances of the case, this application is allowed.

No.24020 of 2019(2) dt.15-04-2019 2/2 Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Banka, in Jaipur P.S. Case No. 19 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
