Petitioners seek bail in a case registered for the offences punishable under Sections 302/34 of I.P.C. For land dispute, the petitioners are suspected to have committed murder of the father of the informant. Submission is that petitioners are in custody since 18.11.2019. Investigation of the case is already complete. There is no eye witness of the occurrence. There is no material to substantiate that petitioners are going to tamper with the evidence or hamper the trial.
Learned counsel for the informant opposed the prayer
Patna High Court CR. MISC. No.15037 of 2020(2) dt.04-03-2020 2/2 for bail.
Since there is no eye witness of the occurrence, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Aazam Nagar P.S. Case No.299 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioners shall fully cooperate with the trial of the case as well as the petitioners shall not leave the country without permission of the learned Trial Judge, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
