Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act. The petitioner is in custody since 03.11.2016. Name of the petitioner has surfaced in the FIR on the basis of confessional statement of co-accused Brajesh Kumar Rai who has already been allowed bail by a Coordinate Bench of this Court vide order dated 07.02.2018 passed in Cr. Misc. No. 51514 of 2017.

Considering the period already undergone by the

Patna High Court Cr.Misc. No.1435 of 2018 (5) dt.16-04-2018 2/2 petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Patepur Police Station Case No. 71 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
