2. With the consent of both the parties, this writ application is being disposed of at this stage itself.

3. In the present writ application, the petitioner-College has prayed for the grant of following reliefs: (i) For issuance of an appropriate writ \writs, order\ orders, direction\ direction in the nature of mandamus directing the respondent authorities to send the Pre Admission

Patna High Court CWJC No.5424 of 2026(2) dt.02-07-2026 2/3 mandatory Tuition Fee of near about 268 Students of B. Tech for sessions 2013-14, 201415 and 2016-17 to the petitioner's Institution Account in pursuance of Memo No.-4\ NidhePravishokottar- Chhatravriti-140-01/2014-165, Patna dated 27.01.2014 issued by the Principal Secretary, SC\ST Welfare Department, Bihar, Patna.

(ii) For issuance of an appropriate writ\ writs, order\orders, direction directions in the nature of mandamus directing the respondent authorities to decide the representation dated 27.01.2026 which was send through Registered postdated 28.01.2026 (Annexure P\.5.) in accordance with law within short span of time. (iii) For grant of any relief(s) the petitioner would be found entitled to in the facts and circumstances of the case.

After advancing some argument, learned counsel for the petitioner submits that for seeking the aforesaid reliefs, the petitioner is prepared to file a representation before the District Welfare Officer, Gaya, (Respondent no. 6) and prays that an appropriate direction be issued to the District Welfare Officer, Gaya (Respondent no. 6) to dispose of the representation within a fixed time frame, after giving an opportunity of hearing to the petitioner-College.

5. To the aforesaid submission being made by learned counsel for the petitioner-College, learned counsel appearing for the respondent-State does not have any objection.

6. Considering the limited nature of prayer being made by learned counsel for the petitioner-College, this writ application is disposed of granting liberty to the petitioner-College to file an

Patna High Court CWJC No.5424 of 2026(2) dt.02-07-2026 3/3 appropriate representation before the District Welfare Officer, Gaya, (Respondent no. 6) within one month from today for seeking the relief which the petitioner has claimed in the present writ application. If such a representation is received from the petitioner-College within the stipulated time, the District Welfare Officer, Gaya (Respondent no. 6) shall disposed of the same within a further period of six months from the date of receipt of the representation, after giving an opportunity of hearing to the petitioner-College.

7. It is made clear that if the petitioner-College is found entitled to grant of relief which the petitioner would be claiming through the representation, the same should be extended to the petitioner-College within a further period of six months from the date of final consideration of the representation.

8. With the aforesaid observation/direction and liberty granted, this writ application is disposed of. All pending interlocutory application(s), if any, shall also be deemed to have been disposed of. (Alok Kumar Sinha, J) anuj/namrata U
