JUSTICE SUDHIR SINGH ORAL ORDER 21-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 341, 323, 324, 307 and 506 of the Indian Penal Code.
It is alleged by the informant that on the date of occurrence on a trifle matter the accused persons assaulted the informant and other persons with lathi, danda, bricks and stones due to which all the three persons sustained injuries on their bodies. The further allegation is that accused Mukesh Choudhary
Patna High Court Cr.Misc. No.25605 of 2015 (3) dt.21-09-2015 always threatened with fire arms.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is a case and counter case. It has further been submitted that Section 307 of the Indian Penal Code is not attracted in the present case and as there is no such injury to suggest the application of Section 307 Indian Penal Code. The petitioners are the neighbours of the informant. It has been submitted on behalf of the State that the petitioners are named in the FIR.
Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Shir Nishit Dayal, Judicial Magistrate, Ist Class, Bhagalpur in connection with Kajraili P.S.Case No.02 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
