JUSTICE BIRENDRA KUMAR ORAL ORDER 09-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Sections 304B/201/34 of the Indian Penal Code.
The petitioner is husband of the victim of dowry death. The victim died soon after completion of her seven years of marriage. The FIR was lodged after disposal of the dead body. Allegation is that death was caused due to non-fulfillment of the dowry demand.
Submission is that the victim was suffering from some mental disease for which she was under treatment. The family members of the victim had participated in the funeral
Patna High Court Cr.Misc. No.59695 of 2017 (6) dt.09-04-2018 P2/ which would be evident from the photographs produced by the petitioner in Court and the false case has been lodged to put pressure.
Just to identify the family members of the informant along with dead body, the informant was noticed but he did not appear in spite of receipt of notice.
In the circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Pariya P.S. Case No.54 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
