JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-07-2018 The petitioner is apprehending his arrest in connection with Complaint Case No. 266C/2018, registered for offences punishable under Sections 323, 451, 354(B) of the Indian Penal Code.

Allegation against the petitioner is that he thrashed the informant on the ground and tried to infringe her modesty and on hulla people assemble and the informant was saved. It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and no case under Section 354(B) is made out against the petitioner and at best it is a case under Section 354(A).

Heard learned A.P.P. also.

No.42578 of 2018 (2) dt.23-07-2018 2/2 Having heard both sides, in view of the nature of allegation, I am not inclined to grant the privilege of anticipatory bail rather this application is disposed of with direction to the petitioner to surrender before the court below and make prayer for regular bail, which will be considered by the court below on the merit of the case and the court below shall pass an appropriate order, if possible, on same day.
