2. The petitioner seeks bail in connection with Amas P.S. Case No. 436 of 2022 registered for the offence punishable under Sections 363 and 365 of the Indian Penal Code to which later on Section 302 of the IPC was added.

3. The petitioner and other accused persons are accused of killing the deceased.

4. Learned counsel for the petitioner has submitted that the deceased has died due to drowning and the post-mortem

Patna High Court CR. MISC. No.21326 of 2024(3) dt.05-07-2024 2/3 report also supports the same. The petitioner is in jail since 05.11.2022.

5. Learned counsel for the informant and learned APP for the State have said that the deceased was in a relationship with the petitioner's sister, initially he called, assaulted and killed by drowning in the well.

6. I have considered the submissions of the parties. The doctor who has conducted the post-mortem has not found any ante-mortem injury.

7. Considering the aforesaid circumstances and the fact that the petitioner is in jail since 05.11.2022, this application is allowed.

8. Let the petitioner, above named, be released on bail after framing of charge if charge has not already been framed, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.-1st Class, Sherghati, Gaya in connection with Amas P.S. Case No. 436 of 2022.

9. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Noncompliance

Patna High Court CR. MISC. No.21326 of 2024(3) dt.05-07-2024 3/3 of the condition will result in cancellation of the bail bonds of the petitioner.
