This is an application for bail in connection with Jamhore P.S.Case No. 60 of 2011 registered for the offences punishable under Sections 420, 406 and 120B of the Indian Penal Code. Allegation as per FIR is that petitioner being Branch Manager of OCPL Company has misappropriated the amounts received from the depositors.

Submission of learned counsel for the petitioner is that he is not Branch Manager of the Company and after realizing that company was not reliable he left the job and joined the Axis Bank. Further submission is that co-accused persons have been granted bail by other co-ordinate Benches of this Court passed in Cr.Misc.No. 23133 of 2016, vide order dated 12.8.2016, in Cr. Misc.No. 22448 of 2016, vide order dated 16.8.2016 and in Cr.Misc.No. 22138 of 2015, vide order dated 10.9.2015 and petitioner is in custody for two months.

Having heard both sides and in view of facts and circumstances, as stated above, and co-accused persons have been granted bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Jamhore P.S.Case No. 60 of 2011, subject to the following conditions :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine ground or without permission of court, his bail bond shall be cancelled.
