Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner apprehends his arrest in Jehanabad Mahila P.S. Case No. 56 of 2019, registered for the offences punishable under Sections 498(A), 34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act. Petitioner is Dewar of informant.
Prosecution case in brief is that all the accused persons including this petitioner used to demand dowry and due to non-fulfillment of the same, they tried to kill the informant
Patna High Court CR. MISC. No.14978 of 2020(2) dt.02-07-2020 2/3 and ultimately, on 29.07.2019 she fled away from her matrimonial home in order to save her life.
It is submitted that petitioner has been falsely implicated in this case. There is general and omnibus allegation. Petitioner is living separately from the informant and her husband and has no concern with their family affairs. Mother-inlaw and father-in-law of the informant have already been granted anticipatory bail by a coordinate Bench of this court vide order dated 07.01.2020 passed in Cr. Misc. No. 85422 of 2019.
Learned counsel for the informant however, vehemently opposed the prayer for bail.
Considering the facts aforesaid and the fact that petitioner is Dewar of informant and he is living separately, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad Mahila P.S. Case No. 56 of 2019, subject to the conditions as laid down under
