The petitioner apprehends his arrest in Warisaliganj P.S. Case No. 315 of 2021, registered for the offences punishable under Section 364 (a) of the Indian Penal Code. FIR was registered against unknown for kidnapping of the son of informant. It is alleged that some unknown persons demanded Rs. 20 lakhs as ransom.
It is submitted that petitioner is not named in the FIR nor named by the victim boy in his statement under Section 164 Cr.P.C. However, during course of investigation, one co-accused Sipu Kumar disclosed the name of this petitioner. Considering the facts aforesaid and statement of
Patna High Court CR. MISC. No.17366 of 2022(2) dt.29-08-2022 2/2 victim boy under Section 164 Cr.P.C wherein the boy has not alleged anything or named this petitioner, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Nawada in connection with Warisaliganj P.S. Case No. 315 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
