Petitioner is languishing in judicial custody since 13.06.2017 in connection with Chousa (Fulout) P.S. Case No. 114 of 2017 for offences punishable under Sections 409 and 420 of the Indian Penal Code.
The prosecution case, as lodged by the supervisor Technofab Engineering Ltd., is that the rural electrification agency was given to the said company who had sublet the contract to the petitioner who was the contractor of M/s Rachana Construction. It is alleged that the petitioner had illegally taken Rs. 400- 500 from each villager in the garb of rural electrification although such work had

It has been submitted by the learned counsel for the petitioner that he is innocent and bears no criminal history. He submits that none of the B.P.L. beneficiaries have come forward for demand of any amount and that charge-sheet has already been submitted. He submits that some of the beneficiaries have stated that no money was demanded by the petitioner and the allegation is subject to enquiry by the District Magistrate and the Block Development Officer of the said area.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Udakishunganj (Madhepura) in connection with Chousa (Fulout) P.S. Case No. 114 of 2017, subject to the conditions that:
(1) Both bailors would be close relative of the petitioner having sufficient immovable property, who will file an affidavit stating their relationship with the petitioner.
(2) Petitioner will appear before the learned court below during
Patna High Court Cr.Misc. No.47586 of 2017 (3) dt.28-11-2017 3/3 trial as and when required and failure to appear on two consecutive dates without assigning any reason will entail cancellation of his bail bonds.
