====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 02-04-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is seeking anticipatory bail in connection with Aoungari P.S. Case No. 03 of 2019 registered under Sections 379/414 of the Indian Penal Code and 26(1) of the Forest Act.

Learned counsel for the petitioner submits that this petitioner is a school teacher and has no business of running of saw mill. The allegation against him is that he was one of the persons who had fled away after seeing the police party when raid was conducted by the police party. Name of the petitioner has transpired allegedly in the statement of the apprehended accused.

Learned A.P.P. for the State has opposed the prayer for

Patna High Court CR. MISC. No.17245 of 2019(2) dt.02-04-2019 2/2 anticipatory bail of the petitioner as according to him the petitioner was one of the persons engaged in transportation of wood illegally.

Considering the facts and circumstances of the case whereunder the petitioner is not said to have been arrested but his name has transpired in the statement of apprehended accused, apart from that there is no other material for the present to connect him in this case, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - I, Hilsa, in connection with Aoungari P.S. Case No. 03 of 2019, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
