The petitioner seeks bail in a case registered for the offence under Sections 272, 273, 290, 504, 34 of the I.P.C. and Sections 30(a), 37(b)(c) of Bihar Prohibition and Excise Act. 185 liters of illicit liquor has been recovered from the shop of the petitioner.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner and shop in question does not belong to this petitioner. Petitioner claims clean antecedent and he is in custody since 23.01.2022. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, clean antecedent

Patna High Court CR. MISC. No.17863 of 2022(2) dt.20-05-2022 2/2 and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Exclusive Special Judge, Excise, Saran at Chapra in connection with Amnour P.S. Case No. 17 of 2022.
