Petitioner apprehends his arrest in connection with Mojahidpur (Babarganj) P. S. case no. 55/2014 registered under sections 448, 504/34 of the Indian Penal Code, 27 of the Arms Act and 3/ 4 of the Explosive Substance Act.

Petitioner is named in the first information report but according to the informant, name of the petitioner was disclosed by the persons who had assembled on the place of occurrence after alleged occurrence.

In course of investigation, only statements of police officials were recorded and seizure list witnesses also do not claim to have seen the petitioner committing alleged crime.

Accordingly, this anticipatory bail petition is allowed and it

Patna High Court Cr.Misc. No.34118 of 2014 (3) dt.03-04-2015 is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Mojahidpur (Babarganj) P. S. case no. 55/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
