JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-11-2017 The petitioner seeks regular bail in connection with Pirbahore P.S. Case No. 321 of 2017, registered for offences punishable under Sections 147, 149, 302 of the Indian Penal Code. Allegation against the petitioner and several others is of dragging and assaulting the deceased causing his death. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and no specific allegation has been made against the petitioner. Further some of the coaccused persons have been granted the privilege of anticipatory bail while some of the accused has been enlarged on regular bail vide orders dated 01.11.2017 passed in Cr. Misc. No. 36282 of 2017, vide order dated 9.11.2017 passed in Cr. Misc. No. 50931 of 2017 and vide order dated 07.11.2017 passed in Cr. Misc. No. 52740 of 2017 and petitioner has been in custody since
Patna High Court Cr.Misc. No.52653 of 2017 (2) dt.14-11-2017 2/3 22.06.2017.
Learned counsel for the State as well as learned counsel for the informant opposed the prayer for bail, however, they could not point out any specific allegation against the petitioner. Having heard both sides, in view of the facts as stated above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Patna, in connection with Pirbahore P.S. Case No. 321 of 2017,subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the
