Petitioner seeks regular bail in connection with Forbesganj PS Case No. 1032/2020 registered for the offence punishable under Sections 414 of the IPC and 25(1-b)A, 26 read with Section 35 of the Arms Act.

Three live cartridges of 7.2 mm has been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that from perusal of the seizure list, it would be evident that stolen motorcycles have not been recovered from the possession of petitioner and the same have been recovered from possession of co-accused persons, namely, Amit Kumar and Dinesh Kumar. He further submits that the petitioner is in custody since

Patna High Court CR. MISC. No.39931 of 2021(3) dt.12-04-2022 2/2 29.12.2020 and the charge-sheet has been submitted in the matter. There is no likelihood that the petitioner will abscond or tamper with the evidences.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is in custody since 29.12.2020, the charge-sheet has been submitted in the matter and there is no likelihood that the petitioner will abscond or tamper with the evidences, I am inclined to grant regular bail to the petitioner subject to the condition that the petitioner will be well represented on each and every date in the trial and if he fails to do so on two consecutive dates, his bail bonds will be liable to be cancelled.

Accordingly, let the petitioner, ARUN YADAV be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj PS Case No. 1032/2020 corresponding to GR No. 4472/2020.
