====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 04-12-2017 Heard Sri Tej Narayan Singh , learned counsel for the petitioner and Sri Arun Kumar Pandey, learned Additional Public Prosecutor.

The sole petitioner, who is in custody since 29.06.2017 in Special Case No. 3161 of 2017 [ arising out of Athmalgola P.S. Case No. 143 of 2017] , registered for the offence under Section 30(a) of the Bihar Prohibition And Excise Act , 2016, has prayed for grant of bail.

At the very outset, it was submitted by learned counsel for the petitioner that petitioner's name in the present case has come on disclosure made by the co- accused, which was made before police, save and except such statement there is no other material to connect the petitioner in the present case and he is

It has been argued that from the auto which was intercepted huge quantity of country made liquor was shown to be recovered and it was alleged as if petitioner along with others fled away from the place of occurrence.

Considering the nature of accusation and period of custody, let the petitioner Raju Choudhary @ Nata Choudhary be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna / concerned court in connection with Special Case No. 3161 of 2017 [ arising out of Athmalgola P.S.
