Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149 of the Indian Penal Code, Sections 25(1-b)A, 26, 35 of the Arms Act, Sections 3/4 of the Explosive Substance Act and Section 17 of the Criminal Law Amendment Act.
The police recovered explosives from the referred place and there is general and omnibus allegation against the petitioner and other co-accused to be instrumental in placing those explosives thereat. The petitioner is in custody since 03.04.2017.
Submission is that the petitioner is accused only for the reason that he has some criminal antecedent detailed in
Patna High Court Cr.Misc. No.54472 of 2017 (4) dt.02-01-2018 2/2 para 3 of the petition, though there is no eye witness. Considering the aforesaid fact, especially, the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barachatti Police Station Case No. 252 of 2012, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
