JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Murliganj P.S. Case No. 364 of 2019, registered under Sections 35(1-b)A, 26 and 35 of the Arms Act.

The accusation is that on receiving secret information about gathering of the miscreants near Cinema Hall Chauk at Jairampur, the informant along with other police personnel reached there and saw three persons present inside the road with motorcycle. On seeing the police party, all started to flee away, but on chased, they were apprehended, who disclosed their names as Sanoj Yadav (petitioner), Pawan Kumar and Sunil Yadav. On search, petitioner was found in possession

Patna High Court CR. MISC. No.16088 of 2020(2) dt.05-06-2020 2/2 of one country made loaded pistol with one live cartridge whereas Pawan Kumar was found in possession of two live cartridges and Sunil Yadav was found in possession of two live cartridges and one knife.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 31.10.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura, in connection with Murliganj P.S. Case No. 364 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
