JUSTICE SATYAVRAT VERMA ORAL ORDER 15-04-2022 Heard learned counsel for the petitioners and learned APP for the State through video conferencing. The petitioners seek bail in a case registered for the offences punishable under Section 30(a) of the Excise Act. The learned counsel for the petitioners submits that the petitioners are in custody since 18.11.2021, they are persons with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 240 litre of liquor from the place of occurrence.

The learned counsel for the petitioners submits that petitioners were not arrested from the spot and their names were

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioners are in custody, they are persons with clean antecedent, charge-sheet has been submitted in this case and were not arrested from the spot, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No.1934 of 2021 arising out of Gaurichak P. S. Case No.101 of 2021. The application stands allowed.
