JUSTICE PARTHA SARTHY ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has prayed for grant of regular bail in a case registered under sections 341, 323 and 386 of the Indian Penal Code.
As per the prosecution case, it is stated by the informant that while he was on way to attend a baraat on his motorcycle, on the point of knife the petitioner looted him of Rs. 1500/- in cash and his mobile phone and threatened to kill him if he raised hulla.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No such occurrence as alleged took place. The informant and the
Patna High Court CR. MISC. No.18183 of 2022(3) dt.06-01-2023 2/2 petitioner are on inimical terms and the petitioner is in custody for 1 year 7 months since 25.5.2021. Charge-sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the petitioner having remained in custody for 1 year 7 months since 25.5.2021 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Palasi P.S. Case no. 99 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria.
