Petitioner is in custody in connection with Laukahi P.S. Case No. 65 of 2018, corresponding to G.R. No. 555 of 2018 for the offence under sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar wine Excise Prohibition Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He is in custody in connection with seizure of 99 liters of Nepali wine. He submits that seizure was not prepared in accordance with requirement under section 100 Cr.P.C. He further submits that petitioner is in custody since 4.5.2018.

Considering the fact that petitioner has no criminal
