Petitioner seeks bail in connection with N.D.P.S. Case No. 20 of 2019 arising out of Industrial Area P.S. Case No. 128 of 2019 registered for the offence punishable under sections 20 and 22 of the N.D.P.S. Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated inthis case merely because he is brother of Md. Sudin. He is separate in residence and mess from the aforesaid Md. Sudin. Petitioner runs an auto-rickshaw and earns his livelihood. Petitioner has no criminal antecedent. Petitioner is in custody since 19.09.2019.

Patna High Court CR. MISC. No.15094 of 2020(2) dt.03-03-2020 2/2 Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is named accused in the first information and there is recovery of huge quantity of Ganja from the house of this petitioner. He, therefore, does no deserve to be granted bail. Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of bail to the petitioner. The same is, therefore, rejected.
