The petitioner apprehends his arrest in Complaint Case No. 1000/2013, registered for the offences punishable under Sections 406, 420 of the Indian Penal Code and 138 of the N.I. Act.
The complainant made allegation that the petitioner took money from him for establishment of a business but the petitioner did not make him partner. The petitioner is said to have issued a cheque of Central Bank of India but the cheque was bounced.
It is submitted that the petitioner lodged a Sanha for
Patna High Court Cr.Misc. No.25710 of 2015 (2) dt.16-07-2015 2/2 missing of cheque and he also informed the Bank about the missing of cheque. Petitioner did not take any money from the complainant.
Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Sikarahana at Motihari, East Champaran in connection with Complaint Case No. 1000/2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
