This application, for grant of regular bail, arises out of Excise Case No.79 of 2021, registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

The learned counsel for the petitioner submits that petitioner is in Custody since 25.02.2021 and charge-sheet has been submitted. Learned counsel for the petitioner further submits that from allegation, as alleged in the FIR, it would be manifest that 353.520 litres of liquor has been recovered from the back side of the Courtyard of the petitioner. Learned counsel for the petitioner submits that it is the joint family house

Patna High Court CR. MISC. No.27354 of 2021(3) dt.22-11-2021 2/2 and does not belong to the petitioner individually. Learned APP vehemently opposed the prayer for bail.

Considering the fact that charge-sheet has been submitted against the petitioner and he is in custody since 25.02.2021, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Session Judge-cum-Special Judge, Excise Act, Samastipur, in connection with Excise Case No.79 of 2021.
