JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-07-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 12.7.2017 passed in Cr.Misc.No. 28508 of 2017 with an observation to conclude the trial within a period of nine months.
Submission of learned counsel for the petitioner is that only on suspicion name of petitioner transpires in this case and on petition filed by learned APP all the charge sheeted witnesses have to be examined afresh, as such trial could not be concluded. Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to
Patna High Court Cr.Misc. No.41390 of 2018 (2) dt.11-07-2018 2/2 the satisfaction of 1st Additional Sessions Judge, Jehanabad, in connection with Sessions Trial No. 56 of 2017, arising out of Shakurabad P.S.Case No. 78 of 2016, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to co-operate in disposal of trial and appear before the trial court as and when required, otherwise his bail bond shall be cancelled.
