22.07.2020 Heard Mr. Amarnath Jha, learned counsel for the petitioner, Ms. Rashmi Jha, learned counsel for the informant and Mr. Bharat Bhushan learned counsel for the State.
The petitioners seek bail in anticipation of their arrest in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 319/2019
dated 08.08.2019 Instituted for the offences under Sections 341, 323, 324, 307, 504, 506 and 34 of the Indian Penal Code. Though both the petitioners are alleged to have assaulted two different persons but the assault perpetrated by petitioner no. 1 has caused one grievous injury on the person of one Puja Kumari. It has been urged on behalf of the petitioner that Puja Kumari was assaulted by co-accused Madan Prasad also and aforesaid Puja Kumari got herself examined in a private hospital. It is the contention of the petitioners that the nature of injury, which has been reported by a private hospital to be grievous is not thoroughly reliable.
It has also been submitted that considering this aspect of the matter co-accused Madan Prasad, who has also inflicted injury on the person of Puja Kumari, has been granted anticipatory bail by a Bench of this Court. Regard being had to the afore-stated facts and taking into account that the petitioners are females, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of this order on furnishing bail bonds of Rs. 10,000/- (Rs.
Chief Judicial Magistrate, Saharsa in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 319/2019 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. .
