Petitioner in the instant proceedings has claimed appointment of class III and IV post on account of killing of his father as he was a victim of scheduled caste category. Specific case of the respondents in the counter affidavit is that in view of extant provision arising out of
Patna High Court CWJC No.13941 of 2014(3) dt.06-08-2019 2/2 Resolution dated 20.12.2010, entitlement of the petitioner on account of father being killed is restricted to compassionate subsidy which has already been paid to the dependent of the deceased.
Claim of the petitioner in the instant proceedings is not sustainable as scheme only provides payment of compassionate subsidy which petitioner has received. Averments made in the counter affidavit are also not disputed or denied by filing any rejoinder.
Writ petition is dismissed.
