JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 23-05-2016 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners apprehend their arrest in relation to Karpi (Sahar Telpa O.P.) P.S. Case No. 22 of 2016 registered under Sections 392 and 34 of the Indian Penal Code. The allegation is that when the informant was going to attend the call of nature in the afternoon, he was surrounded by the three petitioners, who are brothers, and snatched the chain, mobile and some money from the informant.

It is submitted that no such incidence has taken place and this case has been lodged because of admitted land dispute. Reference has been made to the order of the learned Sessions

Patna High Court Cr.Misc. No.22010 of 2016 (2) dt.23-05-2016 2/2 Judge rejecting the anticipatory bail, wherein it has been observed that due to land dispute the petitioners have been falsely implicated in this case.

Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the Above named petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal, in connection with Karpi (Sahar Telpa O.P.) P.S. Case No. 22 of 2016, subject to conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Navaniti Prasad Singh, J.) Rajiv/Amit U T
