The petitioner seeks bail in Rajoun P.S. Case No. 364 of 2017 registered under Section 147/149/341/323/324/307/ 379 /504 of the Indian Penal Code.
As per the prosecution case, the petitioner along with other accused persons are said to have assaulted the informant by means of lathi and khunti and injured him over a land dispute.
It is submitted by learned counsel for the petitioner that the allegation levelled against the petitioner is not specific rather general and omnibus in nature. He has no concern with the aforesaid occurrence. He has no criminal antecedent. There are 15 accused persons named in the F.I.R. but the doctor has found only
Patna High Court Cr.Misc. No.50984 of 2017 (03) dt.20-12-2017 - 2 - two injuries one abrasion and other swelling on the head of the informant and the assailant of the said injury is also not ascertained. The doctor has found the aforesaid injury by hard and blunt substance. The petitioner has been languishing in custody since 25.08.2017.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Rajoun P.S. Case No.364 of 2017.
