JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 06-07-2020 It appears from the averments made in the application that due to non-compliance of the peremptory order dated 22.01.2020 passed in Cr. Misc. No. 4121 of 2020 the said Criminal Miscellaneous Application stood dismissed on record. Although in the application there is no specific averment that the petitioner has complied with the peremptory order, considering the present days circumstance where due to Pandemic COVID-19 even defective applications are being entertained subject to undertaking given by learned counsel for the petitioner that he would remove the defect after start of normal functioning of the Court, this Court directs restoration of Cr. Misc. No. 4121 of 2020 to its original file, subject to the
Patna High Court CR. MISC. No.19441 of 2020(2) dt.06-07-2020 2/2 condition that learned counsel shall file a supplementary affidavit in the said application giving a specific undertaking that he will remove all the defects within three weeks after start of normal functioning of the Court.
