JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149 and 302/34 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged that the miscreants entered into the house and shot dead the brother of the informant since the informant's brother's wife lend some money to the accused Gautam Kumar for which there was some scuffle between them.

It is submitted by learned counsel for the petitioner that the petitioner was not named in the FIR, subsequently after seven years of the occurrence in order to save main accused, the petitioner has been roped in in the present case. Considering the fact that the case was instituted in the year 2006 and earlier anticipatory bail application of the petitioner

Patna High Court Cr.Misc. No.25757 of 2015 (2) dt.14-07-2015 2/2 was rejected by learned Sessions in the year 2012, this Court is not inclined to interfere.

Let the learned court below consider the prayer for regular bail of the petitioner keeping in view of the fact that it has been mentioned that the petitioner is suffering from cancer if he surrenders within a period of six weeks in connection with Dhanarua P.S. Case No. 214 of 2006 pending in the court of learned SDJM, Masaurhi, Patna.

Accordingly, the application is disposed of.
