JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-07-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner is in custody since 28.11.2017 in connection with Kutumba P.S. Case No. 182 of 2017 registered under Sections 170, 171 and 212 of the Indian Penal Code and 25(1-B)a, 26 and 35 of the Arms Act and 17 of the C.L. Act.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has not committed any offence. In fact, the alleged recovery of arms were recovered from the house of co-accused, Arvind Ram and nothing has been recovered from the possession of the petitioner. The petitioner is rotting in custody for the last eight months. Moreover, co-accused having more or less similar allegation has already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 19612 of 2018 and the case of the petitioner stands of better

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad in connection with Kutumba P.S.
