The petitioners apprehend their arrest in Dhamdaha P.S. Case No. 105 of 2003 registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code, Section 27 of the Arms Act and Section 3(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. The informant alleged that the petitioners and others came to the Adivasi Tola and made indiscriminate firing. The wife of the informant was shot dead and many others got firearm injury. The houses of the Adivasis were demolished and articles were looted away.

The learned counsel for the petitioners submits that the petitioners are old man and no specific allegation is made. It appears that it is a case of the year 2003 in which

Patna High Court Cr.Misc. No.22745 of 2016 (3) dt.26-07-2016 2/2 the petitioners are alleged to have made indiscriminate firing killing one person and injured many others only to take possession of the land. The case is pending last 13 years for the appearance of the petitioners and others.

Considering the facts aforesaid, I am not inclined to grant the petitioners anticipatory bail. Accordingly, the same is rejected.
