Petitioner prays for bail in connection with Dhoraiya P.S.Case No. 188 of 2017 registered for the offences punishable under Sections 363 and 366 of the Indian Penal Code. Allegation as per FIR is that petitioner and wife of informant fled away and allegation against wife of informant is that she withdrew Rs.16,000/- from the Bank.

Submission of learned counsel for the petitioner is that the victim lady is major and married and FIR itself shows that she fled away from the house withdrawing money from the Bank and in her statement under Section 164 Cr.P.C. she has stated that she was forcibly kept at Hydrabad and assaulted and solemnized marriage and that appears to be false and concocted story as informant has not stated so in the FIR itself and petitioner is in

Patna High Court Cr.Misc. No.48486 of 2018 (2) dt.03-10-2018 2/2 custody since 26.3.2018.

Heard learned APP also, who has opposed the prayer for bail.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Banka, in connection with Dhoraiya P.S.Case No. 188 of 2017, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
