The petitioner apprehends his arrest in connection with Bochahan P.S. Case No. 307 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that from perusal of seizure list, it appears that nothing has been recovered from the possession of this petitioner. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below

Patna High Court CR. MISC. No.27911 of 2021(3) dt.28-02-2022 2/2 within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in connection with Bochahan P.S. Case No. 307 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
