JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 364 and 302/34 of the Indian Penal Code.

The prosecution case is that the petitioner along with five persons entered into the house of the informant and on pistol point they enquired about the informant and one Renu Devi when they also resorted to fire indiscriminately, subsequently Renu Devi was found in injured condition who was taken to the hospital but she succumbed to the injuries.

It appears that the informant kidnapped Renu Devi wife of one Ravindra for which Complaint Case No. 248 of 2014 was filed against the informant.

It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.25739 of 2015 (2) dt.14-07-2015 2/2 due to alleged enmity, the petitioner has been named in the FIR. Considering the fact that there is specific accusation levelled against the petitioner in the FIR, this Court is not inclined to interfere.

Accordingly the prayer for anticipatory bail is rejected in connection with Pali P.S. Case No. 50 of 2014 pending in the court of learned JM, 1st Class, Jehanabad.
