The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323 and 307/34 of the Indian Penal Code. The prosecution case is that on 29.03.2016
Patna High Court Cr.Misc. No.23402 of 2016 (2) dt.24-05-2016 2/3 at 5.30 A.M. when the informant went to attend call of nature he found that Bulak Sah along with four sons namely, petitioner no. 1 Kishundeo Sah, petitioner no. Sharban Kumar, petitioner no. Dashrath Sah and petitioner no. 4 Raghuvir Kumar variously armed when co-accused Bulak Sah assaulted with the butt of the pistol on the head of the informant and when the sons of the informant came to rescue then the other accused persons assaulted with lathi and danda.
It is submitted by learned counsel for the petitioners out of three injuries of the informant only one injury on the head has been found to be grievous which is specifically alleged against Bulak Sah (non-petitioner), the father of the petitioners. The petitioners' side has also lodged a case against the informant prior to the lodging of the present case. Considering the thrust of accusation against co-accused Bulak Sah and the accusation is omnibus and general against the petitioners, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in
